Abstract:	明確界定地理標誌構成要件是地理標誌法律保護的前提和基礎，但國際公約和各國立法對此規定都非常模糊，包括中國大陸在內的各國實踐尚在不斷探索之中。地理標誌的構成要件應當考慮地理標誌的標識、地理標誌產品的產地範圍、地理標誌標示的產品的特定品質或信譽、地理標誌產品的特定品質或信譽與地理的關聯性等幾個方面。論文基於中國大陸地理標誌現狀，對上述幾個因素進行了深入的分析。 Definition of constitution requirements of Geographical Indications is prerequisite and foundation in the Geographical Indications protection regime. How to define the constitution requirements of Geographical Indications is fuzzy in the international conventions and being researched in the practice in many countries. Constitution requirements of Geographical Indications should focus on the marks of Geographical Indications, original producing area of Geographical Indications goods, a given quality, reputation or other characteristic of the Geographical Indications goods and a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin.
