摘要:	公共設施保留地與公共設施用地，二者之使用目的相同，但法律規定之效果，則完全不同。公共設施保留地，是保留限期征收之公共設施用地。而公共設施用地，只是依據都市計劃，經主管機關編定公布之土地使用計劃。現有之公共設施保留地，依法必須於民國七十七年九月六日前，全部征收完畢。逾期不征收，將視為撤銷。所撤銷者，應為公共設施用地之保留征收權，而不是公共設施用地之使用編定。已經公布實施之土地使用編定，雖然依法可檢討修訂變更，但決不可能在撤銷保留征收權之同時，亦連帶撤銷公共設施用地之使用編定。公共設施用地之配置，是都市建設發展之必備條件。取得公共設施用地之方法，除征收外，依法尚可採用區段征收或市地重劃。如果撤銷公共設施用地之編定，都市中各種土地，均將無法有效使用。
