    Abstract: 中、日兩國均為人口稠密，人地比率偏高，導致土地對生產活動及人民生活的影響，特別嚴厲。故兩國之地權法制及土地征收補償制度，雖有類似之處，然因政治背景及社會型態不同，所以此等制度亦有殊多相異之處。惟彼邦之政治行政制度尚稱完備，故其地權法制及土地征收補償制度中的有關規定而可供我國借鏡者，亦復不少。惟須再進一步加以研究，瞭解其優點所在，俾供擇優參考。本文除為闡述，被邦對土地所有權的觀念並敘述其現行土地征收及補償制度，並針對該制度從事比較分析。據分析結果，進而檢討我國在制度上有所不完備之處，研擬我國地權法制及土地征收補償制度之改進方向，以資今後修正有關法令的參考，期能藉此而有助於建立平均地權的土地制度，並有利於今後土地征收工作的實施，使地價補償標準，更趨於公平合理，獲取土地所有權人的合作，俾便建設現代化的都市社會。
