    Title: 社會國原則——責任主體、類型及界限

    Abstract: 社會國原則作為具有法拘束力之客觀憲法原則,旨在明確揭示追求社會正義與社會安全為國家目標及任務;並且為達此目標之實現,國家公權力負有積極作為之義務。準此,社會國原則之拘束對象乃為「國家」,尤其首要者更是針對享有具體形成社會政策權限之立法者,應無疑義。然而,此也僅說明了國家對於建構與促進公平正義社會秩序之「目標實現」責無旁貸而已。除非憲法更進一步明定有目標實現之「手段及方式」,否則立法者自有廣泛之形成空間。從而,立法者在形成社會政策時,對於國家自身應擔負起何等類型及密度之社會國責任,原則上亦享有裁量權限。在此思考脈絡下,立法者可將國家設定在「給付者」(Lei- stungstrger)之角色,由國家自己無償或有償提供人民合乎人性尊嚴之社會經濟生活條件所需;抑或可以選擇採行社會互助模式,藉由民間社會團體之力直接達到「協助社會弱者再度自助」之目標,而將國家定位在「導航者」或是「保障者」之角色扮演上。關於國家在社會國目標下所可能擔負之責任類型,將於下文進一步說明。惟在此之前,有必要先行簡單交代社會國原則在國家理論上之基本命題,合先敘明。
