    Abstract: 石油管理法已於民國九十牛九月二十七日經立法院三讀通過，能源管理法中關於石油之規定，不再適用。針對違法經營油品業者，其處罰方式，已由往昔之「行政刑罰」更易為「以行政秩序罰為主，行政刑罰為輔」之制裁模式。主管機關在取締違法經營油品，作成違法裁定以及罰鍰、沒入等行政處分前，應滿足行政程序法中所規定之正當法律程序要求。查緝違法經營油品雖屬不要式之行政程序，惟在「程序經濟」與「人民權益保障」間，主管機關應就具體個案為一客觀妥適之利益衡量。
