    Title: 開放資料與巨量資料時代下個人資料保護之挑戰

    Abstract: 政府資料開放被視為繼政府資訊公開後，進一步促進政府透明、提升政府行政效率與效能，落實民主原則，甚至帶動民間創新應用、產業發展之手段；同樣地，不論公務機關或非公務機關，均對巨量資料(分析)懷抱高度期待，認為其能使「資料說話」，甚至真正做到將「資料轉變為財產」。因此台灣、美國與歐盟無不將政府資料公開與巨量資料列為施政之重點項目。然而，不論是政府資料開放或巨量資料分析，均可能涉及嚴肅的個人資料保護問題，甚至對目的特定、告知同意、去識別化等既有個人資料保護法制下之重要概念與機制形成重大挑戰。本計畫研究成果已撰寫成「政府資訊公開法『隱私豁免』規定的解釋與適用—以美國法的比較為中心」(計20,528字)及「大數據與物聯網時代的個人資料自主權」（計26,676字）兩篇研討會論文，分別發表於東吳大學法學院公法學研究中心主辦之「東吳公法裁判研究會」（2014年12月12日），以及中華民國憲法學會主辦之「數位資訊時代與基本權」學術研討會（2015年10月3日）。前者主要以美國立法例及相關實務見解為比較對象，同時檢討台灣行政法院針對上述規定作成的相關判決，希望有助於釐清政資法第
    18條第1項第6款規定各項要件的內涵，導正政府機關在個案判斷上誤用、錯用的情形，並建立具體判斷標準，提供司法審查必要的指引。後者則在國際上全面檢討個人資料保護法制之時，介紹歐盟、美國不同的規範路徑，分析其利弊，並提出四項台灣應該進一步思考的問題，不但與我國個人資料保護法未來修正息息相關，更攸關我國積極推動中的大數據產業的發展。
