Abstract:	區分所有權;騎樓;法定空地;道路交通管理處罰條例;公寓大廈管理條例;無權占有;不當得利;權益侵害之不當得利;所有權之社會性區分所有權人占用自己專有之騎樓，縱然使用不符法律規定，難認為無權占有。況該騎樓之使用利益歸屬占有人，其他區分所有權人未受「權益侵害」而無「損害」，故不具備不當得利要件。無權占有法定空地，係逾越應有部分之範圍使用收益共有物，侵害應歸屬於他共有人的權益內容，縱被占用之法定空地不得出租或供建築使用，仍成立侵害權益之不當得利。蓋不具保有利益之正當性，即當然「致他人受損害」，乃侵害型不當得利之特徵。
