Title:	賄賂罪職務行為之再探討－以民意代表受賄事例為中心

Abstract:	我國刑事法處罰公務員受賄行為，相關明文散見於刑法與貪污治罪條例之中，而貪污治罪條例因刑責較重，早已成為公務員受賄行為事實上適用的條文。依據貪污治罪條例第4條第1項第5款的規定，公務員「對於違背職務之行為，要求、期約或收受賄賂或其他不正利益者」，即構成違背職務的受賄罪，相對而言，即使公務員未違背職務，僅「對於職務上之行為，要求、期約或收受賄賂或其他不正利益者」，依貪污治罪條例第5條第1項仍成立職務行為受賄罪。雖然規範疊床架屋，但至少從貪污治罪條例與刑法相關構成要件中可以讀到，任何公務員均不得將其和職務行為或違背職務行為與他人交易，否則勢將造成國家機能本身的干擾。
