    Abstract: 確定不能犯的印象理論與重大無知說雖然簡明瞭，但從理論基礎上看存在先天不足，具體危險說從一般人觀點虛擬法益的危險性，雖然強調其來自重視法益客觀危險的客觀未遂理論，但其所認定的法益危險，其實來自一般人的共通意識，如果這個共通意讓與現實客觀情況不同，就會發生明明不可能損害法益，但具體危險說認定有危險的結論，為此，有必要堅持徹底的客觀危險說立場，即就表現於外部的行為在事後從客觀上進行考察，如果行為具導致結果發生的危險性就是未遂，否則是不能犯。伱事後觀點判斷有無危險的具體操作方式是，首先，從所有已知的事實中找出無法坎足既遂構成要件的關鍵因素。其次，視關鍵因素是否屬行為人無法控制的隨機事件。如果是，則關鍵因素屬於防止結果發生的變項，這時必須再決定，該變項是否可能以導致結果發生的變項的方式出現，從而損害法益。最後，審視“致果變項”作用的時、空關係，該作用必須發生於原犯罪流程的著手後至最終效果完成前，也必須是原犯罪處所的相同或緊鄰地域。如果能肯定其時空關係，則個案中有事後危險，可判斷屬於相對不能的障礙未遂。
