    Abstract: 依照我國憲法第7條之規定,身心障礙者與其他一般國民享有相同的基本權利保障,我國憲法增修條文第10條第7項進一步明文:「國家對於身心障礙者之保險與就業、無障礙環境之建構、教育訓練與就業輔導及生活維護與救助,應予保障,並扶助其自立與發展」。為落實上述憲法意旨,保障身心障礙者平等參與社會之權利,身心障礙者權益保障法規定許多國家積極作為,包括開發或提供輔具或便利設施,手語服務或視障者能夠使用之教具教材與圖書設備等等,但「經費缺乏」、「身心障礙者只是少數人,資源必須作有效配置」經常是公部門怠於執行的理由,其背後則隱含著整體法秩序對身障者的結構性歧視。 本計畫之研究目的在於探究英國、德國以及歐洲人權法有關平等原則積極促進內涵之實務與學說,並且依照我國憲法及身心障礙者權益保障法之規定,分析公部門應負擔何種內容之無障礙設施設置義務,身障者有無相對應的請求權,公部門若未提供適當輔具給予身心障礙應考人,是否即構成對身心障礙者之歧視等問題。本計畫希望透過學說的充實,提供身心障礙者主張權益更完整的論述,使憲法保障身障者享有平等參與社會、自立發展的意旨能夠真正落實。
    According to Art. 7 of the Constitution of the Republic of China (R.O.C.) the fundamental rights of people with disabilities shall be equally guarantied as the rights of others. In addition, Art. 10, Paragraph 7 of the Additional Articles of Constitution of R.O.C. proclaims that the State shall provide insurance, medical care, barrier-free environments, education and training, vocational guidance, and support and assistance in everyday life for physically and mentally handicapped persons, and shall also assist them to attain independence and to develop. In order to carry out the constitutional requirements mentioned above which are substantially stipulated by the “People with Disabilities Rights Protection Act” (PDRPA), the State are under obligation to create or provide public facilities, such like sing language, accessible reading materials for aurally or visually impaired people or other reasonable accommodations. Unfortunately the State always neglects their obligation by stating that “we are short of budget” or “public resources should be distributed efficiently of the majorities but not for the minorities like people with disabilities. This excuse unveils the structural discrimination against disabled people in the whole legal systems. The purpose of this research is to explore the theories and conventions that promote the principle of equality for human rights of people with disabilities practiced in England, Germany and European. Based on the comparative studies and the regulations of constitution of R.O.C. and PDRPA, this research will analyze the legal issues in Taiwan such as which extent of the barrier-free environments the public sectors are obligate to provide, whether the disabled people have the rights to appeal for such facilities, and whether the public sectors have committed discrimination against disabled if the state doesn’t provide recommendation and forced the people with disabilities to compete with general persons in case of recruitment initiated by the public sectors. This project aims at providing theoretical basis for the rights of people with disabilities in support of their equal participation in the society and their independent development in personality.
