    摘要: 一來透過引進市場機制進行減量,二來面臨因應氣候變遷需要龐大的財務資源,氣候變遷立法下的財務機制,包括財務資金的來源、分配、以及最具爭議性的管理機制的設計,早已經成為國際間以及各國爭論最烈的問題之一。於氣候變化綱要公約為主之國際管制體制下,財務機制的設計相當多樣化,包括資金的來源以及分配,但針對財務機制的管理面,事涉財務機制運作的有效性與公平性,向來頗具爭議性。多樣化的財務機制面貌,對於有高度財務資源需求的國家,以及需要龐大財務資源的氣候變遷減量與調適政策之執行而言,應屬於一相當正面的發展,惟此尚必須取決於相當多的前提條件:例如各類財務機制下的財務來源是否有重疊、財務資源的分配是否有高度集中於某些國家或計畫類型、財務機制管理的分散是否造成使用者於取得財務資源上的負擔等等。若以公約之國際管制體系觀察,對於締約國之需求以及各財務機制運作上,是否有集中化管理的需要?亦或是集中化的管理反而喪失各類財務機制運作時的彈性?此一議題已於公約下引發相當多的討論。對於各國而言,同樣亦面臨類似的難題:面對越來越多樣化的氣候變遷財務機制,包括國際、雙邊、本國,以及公部門與私部門的財務資源,應設計何種類型的管理機制,方得將財務機制的功能極大化的同時,降低行政管理的成本,此即為內國之氣候變遷立法下相當重要的一項法制設計要素。本研究計畫預計對此進行分析,並提供我國氣候變遷立法中涉及財務機制面向的立法設計。
    Market mechanisms have increasingly being used as a policy tool to address climate change mitigation. On the other end, huge financial resources are needed to address climate change mitigation and adaptation. It is, thus, no surprise that climate change financial mechanism has become one of the most debated issues both at the international and domestic scale. Under the international climate change regime, a variety of financial mechanisms have been established to address the financial needs of its parties. Facing this variety, the governance of various financial mechanisms has become an increasingly challenging issue. The increasingly diversified financial mechanisms can be a positive development for countries that require huge financial resources to combat climate change. However, whether this can meet the needs of countries will depend on various factors, such as whether the financial resources are “new and additional”, whether financial resources flow to only a handful of countries and particular types of projects, and whether the proliferation of financial mechanism increases the administrative burden on the applicants. Under the international climate change regime, whether a unified governance regime is needed to manage a variety of financial mechanisms has been increasing debated amongst its parties. Similar dilemma and debates have also been seen on the domestic context as countries need to maximise the benefit of having a variety of financial resources whilst minimise the administrative cost associated with managing a variety of different financial mechanisms. This will be a crucial aspect under domestic climate change legislation, which will be topic of this research project.
