    Abstract: 處於急重症狀態的車禍傷患送醫急救時，若醫療機構或人員於處置上有所疏失，致傷患死亡時，令醫療機構或醫療人員對於傷患的死亡結果負擔全責，並不公平。傷患的急重症狀態雖和與有過失有所不同，仍應類推適用民法第二一七條第一項規定，減輕醫療機構或醫療人員的賠償責任。而受害人所受領的強制車險給付，雖僅得視為車禍加害人賠償責任之一部，但因車禍加害人與有過失的醫療機構之間為不真正連帶債務關係，亦得類推適用民法第二七四條規定，自醫療機構的賠償責任中扣除，以免發生重複受償。內部關係上亦可類推適用民法第二八一條第一項的求償權規定，以維持各該賠償主體之間的賠償責任。
