    Abstract: 甲於民國九十四年五月二十四日以自己為被保險人，向乙保險公司投保人壽保險，契約之受益人欄空白，但保險契約條款約定：「未指定受益人時，以法定繼承人為受益人」。嗣後甲於九十九年八月一日死亡，乙公司依約應給付保險金一百零二萬五千元。甲死亡時並無子女，其父母亦已死亡，依民法其繼承人為配偶A及兄弟姊妹B、C、D，但A則依法辦理拋棄繼承。甲之債權人丙代位ABCD四人起訴請求乙公司給付ABCD四人共一百零二萬五千元，並表明應由丙代位受領。乙公司抗辯：保險金為受益人原始取得之財產，基於概括繼承限定責任原則，丙不得請求以繼承人之固有財產清償繼承債務。1試問何人之主張為有理由？
