Title:	強制汽車責任保險人代位請求賠償與慰撫金請求權之專屬性

Abstract:	甲於民國100年10月11日無照駕駛貨車，違反左轉車應讓直行車先行的規定，於交岔路口不慎撞及騎乘機車的乙，導致其傷重不治死亡。丙等4人為乙之父母及子女，向承保該貨車強制汽車責任保險的A保險公司請求死亡給付160萬元。A公司給付之後，依強制汽車責任保險法第29條第1項但書第5款規定，代位行使丙等4人對甲之慰撫金請求權。甲拒絕給付，並抗辯：慰撫金請求金額過高，且慰撫金請求權具有不可讓與性，A公司無從受讓丙等4人之慰撫金請求權。
