Title:	全民健康保險法代位追償對象之檢討--從八仙樂園塵爆事件談起

Abstract:	民國（下同）104年6月27日，在新北市八仙樂園所發生的塵爆事件，造成近500人燒燙傷，傷亡者的醫療費用，絕大部分由全民健康保險支付。光是前二個月的醫療費用，據估計約在3.47至5.47億元之間。依全民健康保險法（下稱「健保法」）第95條規定，衛生福利部中央健康保險署（下稱「健保署」）可以代位請求賠償。惟依上述健保法規定，健保署只能向加害人之責任保險人代位追償。而據悉本件塵爆事故之場地提供者及主辦單位玩色創意國際有限公司（下稱「玩色公司」）共向二家保險公司投保責任保險，其約定之保險金額總計僅有5,000萬元。即便在保險金額內全額順利代位追償，與健保署支付之金額相較之下，顯然比例極低。從而，因塵爆事件所支出的醫療費用，多數最終將由全體要保人負擔。此一現象引發各界對於健保法代位追償對象妥適性的質疑，進而產生修正相關規定的建議。健保法關於代位對象的規定是否妥適，以及應如何修正，取決於該規定的理論基礎與立法目的，有釐清的必要。本文即擬對此等進行初步分析。
