    Title: 社會秩序維護法拘留處分之檢討

    Abstract: 國民政府自1949年從大陸地區撤退來臺後不久，隨即頒布戒嚴令，諸多人權、自由的社會與政治制度，在戒嚴時期均受到全面性控管。戒嚴時期的政府為了有效地控制社會，必須強化警察對於人民行為、言論、舉措的干預及管制機能，賦予警察諸多直接干預人民權利的違警罰法，自然在戒嚴時代扮演了非常重要的功能，以當時違警罰法的規定來看，各類制裁手段之中，最嚴重的處罰可達7日的人身拘留，考量違警行為形式上不是犯罪，實質上也未能達到太嚴重程度的侵害效果，若課處7日拘留，其處罰內容不可謂不重。透過違警罰法連動的高程度制裁效果，戒嚴時代企盼的社會秩序當然得以維持。
