Abstract:	2014年5月發生鄭捷在捷運上殺人案，造成4人死亡與24人受傷，臺北捷運公司事前已依《大眾捷運法》向新光產險投保「責任險」，若乘客搭車發生意外，就醫費用可由中央健康保險署（下稱「健保署」）代位受害替乘客向保險公司申請理賠，此案醫療費用共129萬餘元，但新光產險卻以此案為合約中「911恐怖主義」除外條款拒賠，臺北地院不認同，判新光產險敗訴，應依約理賠；仍可上訴。
