    Title: 原住民保留地權利之實然與應然─相關行政救濟實務見解分析

    Abstract: 本文主要關注國家在原住民保留地制度中扮演之角色與採取之態度，並聚焦於行政救濟之範疇，冀以探究我國原住民保留地法制中國家角色與原住民族權利保障之現實發展狀況。我國現行之原住民保留地制度，係大量承襲自日本政府殖民統治時期之制度，制度之沿襲是否代表此等「殖民－被殖民」之關係與思維，目前仍然以原住民保留地制度之方式存在於我國？！相關之行政救濟決定與判決，是否相同地重製此等「殖民－被殖民」的刻板印象與潛在意識？若然，我國在現行與未來的制度上，是否以及如何朝向「去殖民」的方向努力，並可能採取何種制度與方式進行調整，也在文章中一併進行探討。本文先以我國原住民保留地之制度形成歷程為始，接續行政法院判決之整理，說明我國目前原住民保留地制度之實然面，隨後再以其為基礎，配合相關研究，論述我國原住民保留地制度之應然面。
