    Title: 轉型正義的範圍及檔案開放問題

    Abstract: 不同的政治體制下，正義的定義，或是「正義典範」也有所不同。轉型正義基本上指涉的，是國家體制從侵害人權的不自由、不民主體制，經過改革（革命）成為自由民主體制之後，根據自由民主的價值，對過去政府及其相關組織或是個人對於人權的侵害，重新做歷史的評價，其主要目的在於記取歷史教訓，以避免類似的狀況再發生，達成鞏固自由民主的效果。此外，討論轉型正義的相關問題，必須確認在動員戡亂及戒嚴體制下，人權遭到公權力的不當侵犯的內涵，除包括最基本的自由權之外，還有財產權的問題。而強人威權統治時代的國民黨當局，對可能反對、衝擊其統治體制或是政策的個人或是團體，也未必都是以叛亂或是政治案件的方式加以處理，換言之，可能出現以處理經濟犯罪或是其他類型的名義，來壓制異議人士或是反對團體。一般而言， 如Andrew Rigby 指出的:轉型正義包含需要真相（need for truth）、追求正義（quest for justice），以及渴望和解（desire for reconciliation）等三個面向。唯有真相才能有真正的正義，唯有正義才能真正的和解。（註1）不過，轉型正義涵蓋的案件內容，或是追究責任範圍，應該有多大？如果轉型正義檢討的範圍，還小於戒嚴或是動員戡亂體制下，「戒嚴法」或是政府部門內部檢討，都認為必須提供救濟，或是必須修正的範圍，就明顯有所不足。
