    Title: 從道歉、和解到正義實現：談以國土計劃落實原住民族土地權之可能

    Abstract: 我國總統在2016年8月1日在總統府代表政府向原住民族道歉，其發言指出歷來政權對原住民族的傷害，並引用泰雅族sbalay的哲學，說明釐清真相與尋求和解的意義。在國家和原住民族的關係中，最敏感而容易有潛在衝突的，即是土地的議題，它也是對於雙方從和解邁向共生之智慧的最關鍵考驗。本文從總統道歉所呈現之多元史觀的意涵，討論擺脫殖民敘事、建立新的國土論述之重要性，並展開幾個部分的工作：（1）回顧原住民族遭遇的土地問題、我國原住民族土地權架構的沿革，檢視原住民族土地權無法落實的原因；（2）指出國土計劃法通過之後新的國土計劃體系，以及原住民族在其中的角色定位；（3）分析透過國土計劃法中之「特定區域計劃」、「涉及原住民族土地之特殊土地使用管制」、「諮詢與同意權」等工具，落實原住民族土地權之可能。最後，本文建議，雖然國土計劃法為原住民族土地權之落實提供了新的制度環境，但應避免為了行政操作之便利或機關的本位主義，扭曲了原住民族的土地文化，反而造成新傷害，也因此，從國家和原住民族之關係的重新調整、實現修復正義的高度，來思考國土工具之運用，乃有極高的必要性。
