    Abstract: 性自主意識的支配是修法後妨害性自主罪所保護的主要法益,文章中以該罪章所處罰的行為與法益的侵害程度兩種不一樣的思考為出發點,分別對該罪章製作出二種不一樣的犯罪類型的體系分析。在體系的交叉比較後,尤其在以法益保護為主的思惟中,本文試圖以性自主權的當然侵害與性自主權的擬制侵害為體系分析的上位概念,而分別檢驗現有犯罪類型之規範妥當性。其次在妨害性自主權行為的討論中,本文認為在刑事立法政策的考量下,不應再將焦點置於現有概念的闡釋,文章中以人類社會性觀念的變遷,探究性行為之本質以及現有社會價值對性自主權之認識,並以現有社會價值的呈現,闡明刑法妨害性自主之行為規範應有的表達。
