Title:	自兩件外國過失不實陳述判決論民法第245條之1第1項尤其第1款之妥適性

Abstract:	本文以兩件外國判決有關過失不實陳述，且均僅涉及純粹經濟損失，卻又不成立債務不履行之個案，說明此類案例適用民法第二四五條之一第一項尤其第一款之困難。本文並檢討民法第二四五條之一第一項尤其第一款之妥適性，即立法者誤認契約成立即不生締約上過失；亦未注意締約上過失制度對錯誤或被詐欺之意思表示規定之關聯性與補充性；更忽略締約上過失制度乃契約與侵權行為之中間制度，主要目的在於保護被害人之純粹經濟損失或單純財產損害。最後，建議最高法院遇有相關案例，宜謹慎解釋適用第二四五條之一第一項規定。
