    Title: 吹哨者之勞工保護與企業法遵義務:「一例一休」之權利保障與雇主勞動條件明示義務

    Abstract: 立法院為使本次一例一休之立法得以落實,而於相關配套修法的同時增設所謂「吹哨子條款」;一方面提供勞工得以個別或集體方式向政府機關揭露企業之「不法勞動」的途徑,並間接尋求或回復法律上正當之權利;另一方面也以公權力的手段,保護個別勞工因揭發企業之勞動違法,而於雇用關係上受有不利益之對待。同時修正勞基法第二三條規定,要求雇主應負有勞動條件明示之義務,以使勞雇雙方權利義務更加明確,且勞工得以掌握關於工資之完整資訊。此一規範相當於日本勞動基準法第十五條(勞動條件明示)之規範;即,勞資雙方於簽訂勞動契約時,雇主必須明示工資、勞動時間等勞動條件,特別是有關工資事項應以書面說明。對此,本文除介紹我國勞基法之吹哨子條款,以及於勞動檢查實務如何操作之方式與可能產生的困難之外,並借鏡日本學說之經驗,進一步說明該原則之主要內涵,以作為我國未來之借鏡。
