Title:	吹哨者之勞工保護與企業法遵義務：「一例一休」之權利保障與雇主勞動條件明示義務

Abstract:	立法院為使本次一例一休之立法得以落實，而於相關配套修法的同時增設所謂「吹哨子條款」；一方面提供勞工得以個別或集體方式向政府機關揭露企業之「不法勞動」的途徑，並間接尋求或回復法律上正當之權利；另一方面也以公權力的手段，保護個別勞工因揭發企業之勞動違法，而於雇用關係上受有不利益之對待。同時修正勞基法第二三條規定，要求雇主應負有勞動條件明示之義務，以使勞雇雙方權利義務更加明確，且勞工得以掌握關於工資之完整資訊。此一規範相當於日本勞動基準法第十五條（勞動條件明示）之規範；即，勞資雙方於簽訂勞動契約時，雇主必須明示工資、勞動時間等勞動條件，特別是有關工資事項應以書面說明。對此，本文除介紹我國勞基法之吹哨子條款，以及於勞動檢查實務如何操作之方式與可能產生的困難之外，並借鏡日本學說之經驗，進一步說明該原則之主要內涵，以作為我國未來之借鏡。
