    Abstract: 對於未遂行為刑法處遇的探究,其實就是針對一個沒有成功的犯罪行為,卻加諸刑罰作為法律效果的論述分析。相對於犯罪學以人類以及社會生活的偏差行為,作為觀察犯罪的出發點,將犯罪定位為涉及人類內在行為決定因素與外在社會環境因素,所形成之多面向而錯綜複雜的法事實與社會現象1,這裡所謂未遂的犯罪行為,則是專指刑事實體法上具備有應刑罰性格之不法行為的特定階段。將未遂的犯罪行為連接刑事實體法的犯罪定義,主要是企圖藉由刑事不法之形式與實質的意義,思考在犯罪階段中未遂行為的處罰基礎,而將討論聚焦於以各個犯罪階段之上位犯罪定義作為出發點,所呈現的未遂行為刑法處遇的適當性,以及判斷著手的評價標準。
