    Abstract: 繼前講已經介紹了法國相關國際法教科書上關於國際法與國內法關係之論述後,本講將繼續介紹法文法學論述相關於歐盟法之部分。以下段落,為Antoine Masson所著二八年版「歐洲共同體法」教科書中,相關於歐洲法院之先決問題(la question préjudicielle)之段落。需注意者是,自二九年十二月一日起,里斯本條約生效,因此舊有之歐洲聯盟條約(Traité sur l`Union européenne,簡稱TUE)與歐洲共同體條約(Les Traités instituant les Communautés européennes,簡稱TCE),被新的歐洲聯盟條約(依舊為TUE)與歐洲聯盟運作條約(Traité sur le fonctionnement de l`Union européenne,簡稱TFUE)所取代。而依新的歐洲聯盟條約第一條第三項,歐洲共同體正式由歐洲聯盟所取代且繼受。自此歐洲共同體正式步入歷史,只剩下歐洲聯盟。唯以下關於歐洲法院之討論,雖條文編碼在里斯本條約後有所變更(將會在相關處註記),但基本概念仍屬一致。然諸多communautaire(共同體的)之形容詞用法,例如le juge communautaire(共同體法官),在理解上,於新條約生效後應理解為le juge「européenne」(歐盟法官),但以下翻譯仍從原教科書之文字。
