Abstract:	勞動法中的行政任務,例如德國法所稱之勞工行政,或說:勞動法上之行政(arbeitsrechtliche Verwaltung),是否也同樣受著催生公私協力之力量所影響,進而出現諸如公私協力之形式與實質呢?在此,我們需要某個程度的回到勞動法之基本的自我認知(Selbstverstndnis),重新思索與探尋勞動法領域中的「公-私關係」,方能適當地企圖將公私協力鑲嵌進去,不論是否成功,也不論是否與其他行政領域呈現迥異之面貌。這便是本文「貳;前理解一」,所嘗試回答的。
