Abstract:	先論本號解釋所辨識之基本權利標的。本案聲請人主張系爭法律(社會秩序維護法八九條第二款)所侵害之憲法上基本權利為「新聞自由」與「工作權」;本案解釋所闡釋應受憲法保障並足以發動本案違憲審查之基本權利,則為「人民依其意志作為或不作為之一般行為自由」、「新聞採訪自由」及「工作權」。兩相對照,可知聲請人雖未主張,而大法官仍主動提及「一般行為自由」作為解釋之主要標的權利之一,值得注意。
