Title:	專利權之公示與公信—以我國專利法第26條第1項為中心

Abstract:	專利乃基於明確政策目的所創設出的特別物權。其政策導向的特質反映在促進國家產業技術發展創新的終極目標。而為達成此立法目標，一方面藉由專利的授予，提供發明人有限度的排他權（exclusive rights），令其適度回收其研發成本，並獲致合理的利益，確保未來繼續研發的誘因；另一方面，為促進發明有效的貢獻，以利於發明實施對於產業所生之增益，或助於未來相關技術的累積創新，專利制度亦要求發明人需向公眾揭露「高品質」的發明，以作為排他權賦予的對價。一般而言，「高品質」的發明乃形成現今專利法對於專利標的與專利要件的要求，以發明專利為例，例如：專利法對於發明（invention）的界定；新穎性要件（novelty or new）、進步性要件（non-obviousness,or an inventive step）、產業利用性（utility or industrial application）。然而「高品質」發明固為專利制度所期待，該發明欠缺與公眾相連通或交流的機制，實無法對產業發展有所貢獻或增益。此與公眾相連通或交流的機制，有賴於發明人對於其發明的揭露，揭露主要是藉由申請專利範圍（claims）與專利說明書（the specification）為之，依現行專利法的規定而言，為獲致專利的保護，發明人對其發明的揭露不僅要符合「申請專利範圍」的「明確性」（definiteness），在專利說明書的揭露上更要能使「申請專利範圍」的相關技術能被「據以實現」［或可稱為「可實施性」（enablement）］。
