    摘要: 消保法有消費者憲法的美名，在臺灣法制發展史上具有特殊地位，形成過程涉及政治環境解嚴、社會參與提升、消保意識高漲等因素相互作用。在內容上，涵括行政組織、層級及運作模式，及民事責任特別規範、訴訟外紛爭解決機制與訴訟程序特別規範。在特性上，具有特殊時代背景產物、以特定機制調控私法秩序、政策導向的解釋內涵、價值導向的解釋方法等內涵。相關問題涉及政策理念、法律論證及社會發展，實須整合實體法及程序法，提出融通理論作為解釋適用的參考架構，方足以因應現代消費社會層出不窮的挑戰。
