Title:	1532年《卡洛林那法典》与德国近代刑法史——比较法制史观点

Abstract:	《卡洛林那法典》是德国刑法从中世纪的习惯法过渡到当代刑法典的重要法规范。德国早期并无成文的刑法，今日刑法所规范的对象在德国中世纪是由传统的习惯法加以规范。一般认为德国能够从以习惯法规范刑罚走向以成文的法规范加以规范，主要受到德国继受罗马法的影响。目前东亚多数地区的刑法，主要受到19世纪以来，德国的刑法理论与刑法规范的影响。关于德国刑法制度如何从习惯法逐渐发展成为当代的刑法典，并成为影响目前许多国家刑法体制的参考典范，在东亚地区尚缺乏相关研究文献。{1}德国刑法学大师冯·李斯特（Franz von Liszt,1851-1919）在其《刑法学教科书》中曾说，《卡洛林那法典》的内在价值实际成为300年德国普通刑法的存在与发展基础。{2}因此，研究《卡洛林那法典》的内容及其时代意义，具有很高的学术价值。
