Abstract:	生物醫學研究及其技術移轉的「利益衝突」(conflict of interest)議題，即使經歷二○一○年中研院陳垣崇事件與二○一六年中研院前院長浩鼎事件，但是相關概念在臺灣，卻仍然有待釐清。而二○一一年以來我國法律規範所要求的利益衝突揭露與管理制度，多年來在許多學校機構中似乎規範條文含混矛盾，而且並沒有落實執行。本文一方面指出：對於相關制度背後的目的原理沒有清楚理解，是許多誤解、規範含混矛盾與無法落實執行的可能原因。另一方面，本文依據時間階段及性質，將利益衝突的法令規範架構，區分為「研究開始前及研究進行中之規範」及「研究成果歸屬及運用時之規範」兩大類別，詳細論述其規範之位階層次與主要內容。
