    Title: 登山災難、國家責任與救災行政

    Abstract: 民國（下同）100年2月27日學生張○崴（下稱「張君」）申請進入南投縣白姑大山進行登山活動，2月28日最後一次對外以手機聯繫後，因為當晚仍未返回住處，其女友即向南投縣警察局仁愛分局報案，3月1日中午南投縣消防局展開搜救，雖然消防局出動600多人次，經過51日搜山救援行動，仍無所獲，在第52日民間山友入山搜救，翌日即在南投縣消防局聲稱已搜過之溪谷尋獲張君之大體。張君之父母因而主張：東勢林管處管理白姑大山山域怠於設置明顯指示路標、南投縣警局未確實審核張君申請入山管制條件、臺北市警局士林分局怠於取得張君之雙向通聯紀錄、南投縣消防局搜救指揮系統紊亂與搜救小隊搜救不確實、行政院內政部消防署未能充分整合民間團體救災能量，疏於督促考核下級之救災勤務，上開各機關怠於執行職務共同導致張君死亡，應共同負國家賠償責任，故依據國家賠償法第2條第2項與第5條，民法第192條第1項、第2項及第194條規定，請求賠償。第一審臺灣臺北地方法院於104年5月27日之101年度重國字第30號判決，判定南投縣政府消防局擔負國家賠償責任，並賠償新臺幣2,669,940元。被認定成立國家賠償責任之南投縣政府消防局不服提出上訴，第二審臺灣高等法院於106年12月27日之104年度上國字第14號判決，認定南投縣政府消防局上訴有理由，廢棄第一審判決，駁回張君父母之國家賠償訴訟請求。儘管二審法院判決改判國家賠償責任不成立，但因為一審判決乃是目前我國山難成立國家賠償之首例，因而引發相當關注與議論，又何以一二審判決認定國家賠償成立與否不同？以下將先進行兩次判決之初步比較，接著再進行國家責任理論與我國救災行政法制之相關論述。
