    Title: 新興科技傳播媒體適用現行法規之探討－兼論創制傳播基本法

    Abstract: 本文旨在說明在傳播科技的衝擊下，現行法規無法應付相關挑戰與變遷，因此，本文建議以創制「傳播基本法」進行回應。然而，本文指出如何創制基本法涉及不少「政治因素」，需要透過以下方式來獲得「政治解決」：(1)贊同以多元傳播孔道代替寡頭傳播孔道；(2)認知以輔導傳播媒介，代替管制傳播媒介；(3)認知科技傳播服務，目的在便民而非便官；(4)贊同以疏導媒介報導，代替防堵媒介報導；(5)贊同適當地分散高效率的媒介經營權。本文強調，當初立法機構制定傳播、電信法規時並未預料會出現新技術、新媒介，如何為這些新媒介建立一套井然有序的法律結構以及提供合理的行為模式，將是傳播界、法律界的共同課題。
