    Title: 我國報禁問題及解決之道

    Abstract: 報禁、黨禁與戒嚴令的存廢，是我國當前政治環境敏感的三個問題。其中報禁涉及新聞政策，是我國報業現狀中最複雜又棘手的問題。本文所謂報禁的定義，是指「禁辦新報」或「政府不發給新報紙的登記證」，僅限於「限證」的部分，而不包含「限張」與「限印」。我國報禁的法令依據有二，「國家動員法」與「出版法」，實際實施日期是在民國四十年六月十日，而我國實施報禁的理由有四：（一）有紙張短缺之虞；（二）報紙的家數和發行量已達到飽和點；（三）防止報業的惡性競爭及壟斷；（四）防止中共利用報紙做分化、滲透與顛覆之工具。其中前三點理由實難以令人信服，唯有最後一點才是我國實施報禁的真正理由。儘管政府有四大理由主張不開放報禁，但主張開放報禁的人士則有不同意見，包含「報禁」違反新聞自由、「報禁」使得轉讓登記證成為獲取暴利的途徑、「報禁」使公器淪為私器、「報禁」使對新聞工作懷有抱負之青年遭到挫折、「報禁」之法令依據脆弱、「報禁」違反政黨平等原則等。但報禁若解除也可能產生一些影響，本文亦提出了報禁開放前應有的準備工作，例如提供一年緩衝期、確立新聞哲學、制定新聞政策、修訂新聞法規、建立民主傳播制度、建立專業組織、強化新聞評論會等，讓報禁的開放成為奠定國家長治久安的基礎。
