| Abstract: | 本文從跨層次的角度出發，探討中國如何透過外交活動來達成其國內的經濟成長目標，以及如何運用其提升的經濟實力來推動與促進其對外關係。隨著中國經濟實力的提升，目前已經成為繼美國之後的全球第二大經濟體，因此各國皆競相與中國建立起緊密的貿易投資關係，甚至洽簽雙邊或多邊的經濟合作協定，以分享由中國經濟發展擴散所帶來的利益。中國於國際投資身分上的轉變以及對外投資受到中央高層經濟政策的重視，凸顯出中國積極參與投入國際投資活動，本文針對投資保護與促進所洽簽的雙邊協定在該過程中發揮著何種作用以及其具體實踐為何進行探討。同時針對投資保護與促進所洽簽的雙邊協定於中國經濟外交政策中的角色定位為何進行分析。研究發現對外洽簽雙邊投資保障協定是中國推展經濟外交政策的一種措施，且導致中國對外雙邊投資保障協定政策演變的因素反映出中國推動經濟外交政策的政治經濟考量。中國雙邊投資保障協定之實踐，包含締約國之選定、協定範本的規範內容在價值取向上的轉變與所側重的政策目標之不同，反映出中國基於自身在國際上經濟實力懸殊的現實情況以及與國際體系運行規則接軌之對外戰略考量而導致其實踐與各國，尤其是已開發的歐美國家的BIT實踐趨於一致。 |
