    Title: 被占用之國有公用土地排除占用成效及使用補償金追收率之探討
    Illegally occupied state-owned land—the perspectives of repossession and penalty

    Abstract: 我國國有財產制度設計,將國有土地區分為由各直接使用機關管理之公用土地及由財政部國有財產署(以下簡稱國產署)統一管理之非公用土地兩大類。其中公用土地應由各管理機關依預定計畫及規定用途使用,原則上應無被占用之可能,然而實際上,卻有逾5千公頃之國有公用土地遭占用,恐耽誤公共建設之進行,是政府待解決之重要課題。
    過往研究雖指出處理國有被占用土地之困難,但對公用土地被占用之論述著墨甚少,更缺乏對管理機關排除占用情形及向占用者追討不當得利之研究。為彌補過往研究缺口,本研究先藉由整理98年至104年公用被占用土地的分佈及管理機關處理實況,釐清公用土地被占用的問題本質,進一步採用多元線性迴歸模型,找出影響公用被占用土地排除占用與使用補償金追收成效之因素。另外,本研究視國產署將管理公用土地之權力委託予各直接使用機關行使之制度設計為一代理關係,將以代理理論之觀點,解釋國有公用土地管理上遭遇的問題及對制度變革提出建議。
    實證結果發現,現行制度設計未提供管理機關足夠誘因與激勵制度,再加上有效監督管理機關排除占用及追收使用補償金之機制薄弱,難促使管理機關積極處理占用,應於現行制度加入可消除或避免代理問題發生之機制。另外,在公告地價向上調整確實有助於管理機關排除占用成效之情況下,若適時請地方政府於調整公告地價時將土地占用情形納入考量,有助於排除占用之成效。
    Under the National Property Act, state-owned land is divided into two categories; public-use land and non-public use land. Non-public use land is directly administered by the National Property Administration. In contrast, public-use land is managed by administration authority under the supervision of the National Property Administration. Each administration authority is required to establish a plan to ensure the proper use of public-use land. Theoretically, public-use land should only be used for public facilities or infrastructure. However, more than 5,000 hectares of public-use land is currently illegally occupied, which may cause delay in public construction.
    Although previous studies have pointed out issues of non-public use land being illegally occupied, there is little discussion on the public-use land. In consequence, there is a lack of in-depth research on the settlement between the administration authority and occupants. Therefore, this study first analyses occupied land data and adopts multiple linear regressions model to discover factors that would impact occupied land vacancy rate and compensation claiming rate by the administration authority. This study employs agency theory to explain the disconnections between the mandate of administration authorities and the actual situation, and make suggestions for future institutional reform.
    The result shows that little incentives are provided for administration authority to repossess illegally-occupied land or to claim compensation. Therefore, several mechanisms are suggested to be added to current regulations to prevent agency problems, such as raising the announced land value. If the local governments would consider the situation of illegal occupation of public use land as a factor when re-assessing the announced land value, the enhanced land value would help improve the repossession rate of the occupied land.
