Title:	被告同意傳聞證據之適用範圍

Abstract:	甲因涉及販毒遭刑事機關偵查，乙在警局接受警方詢問時，指出甲確實曾販賣毒品給伊，後檢察官起訴甲。審判中，乙已病逝，無法傳喚到庭作證，然甲及其辯護人對乙於警局供述之證據能力均未表示異議，且同意作為證據，法院亦認為適當，遂將乙之上述供述作為判決甲有罪的證據之一。法院之判決是否適法?
