Abstract:	關於遺囑之方式,由法律明文定之,不許遺囑人自由創設(民法一一八九)。我國民法關於遺囑定有五種之方式:一、自書遺囑(民法一一九)、二、公證遺囑(民法一一九一)、三、密封遺囑(民法一一九二)、四、代筆遺囑(民法一一九四)、五、口授遺囑(民法一一九五)。其中口授遺囑又可分為筆記口授遺囑與錄音口授遺囑二種,前四種遺囑為普通方式,第五種遺囑為特別方式,須於特殊情形下始得為之。
