Title:	暫時性重製與合理使用

Abstract:	在網路與電腦資訊設備普及之後,在使用網路或資訊產品之際,例如,執行程式或從網路讀取或下載資料時,都會在RAM中產生暫時性重製。因此暫時性重製(transitory copy, temporary copy)是否構成傳統著作權法所稱的「重製」(reproduction)問題,亦衍生爭議。在美國,第九巡迴上訴法院早在一九九三年於MAI Systems Corp. v. Peak Computer Inc., 991 F. 2d 511一案中,判決被告因為修理檢測電腦系統之需要,而在RAM中載入電腦程式,因此所產生的暫時性重製構成侵害著作權。此判決一出,即引發各方的爭論。
