    Title: 攜帶兇器竊盜的兇器概念,

    Abstract: 本案例事實所牽涉的主要問題在於,攜帶石頭行竊,是否符合刑法第三二一條第一項第三款「攜帶兇器」之規定。對於兇器的判斷,我國實務認為只要行為人在行竊時有攜帶兇器的事實,就已經滿足其要件,至於行為人攜帶兇器之初,是否主觀上有持以行兇或反抗的意思,以及兇器是否原屬行為人所有,皆不重要。另外關於兇器的概念,最高法院在七十九年台上字第五二五三號判決認為,凡「客觀上足以對人之生命、身體、安全構成威脅,具有危險性之兇器均屬之」。這樣的解釋除了顯現兇器必須對於人之生命、身體存在有侵害可能的危險性之外,並沒有給予兇器確定的完整概念。因為將兇器定義為具有危險性兇器,事實上就好像在說「好人就是善良的好人」一樣,只是單純的彰顯了解釋對象應該具備有的特性,至於何謂「兇器」的事物類型,則因為缺乏說明,而無從知悉事物範圍的限定。
