Title:	民法親屬編：第三講婚姻之實質要件

Abstract:	在封建社會中,結婚當事人並無婚姻自由權,蓋以往因受父母之命及媒妁之言之限制,媒妁之言於前,父母決定於後,男女對婚姻方面之意思,無法直接表示。亦即,古代之婚姻,尊長握有主婚權,當事人意思如何,可不必問。民國成立後,民法親屬編制定前,仍保有此封建社會之傳統。依大理院判決例認為,現行律載嫁娶應由祖父母、父母主婚,祖父母、父母俱無者,從餘親主婚。是婚姻不備此條件者,當然在可以撤銷之列(二私訴上二號)。又父母為子女主婚,如尚有直系尊親屬在堂,應秉承其同意(八上二三六號);亦即,祖父母、父母俱在,而又係同居者,自應由父母主婚,惟依家政統於一尊之義,亦應得祖父母之同意,否則祖父母得予撤銷婚約(七上二九八號)。惟主婚之權畢竟應由父母行使,因此,祖父母為之主婚,而父母事前不知者,自得撤銷其婚約(九上七七六號)。
