Abstract:	本例中,被繼承人係以遺囑指定遺產分割之方法,為尊重被繼承人之意思,且為避免重行分割所生之複雜化,應解為丁不得主張重行分割。惟,其所分得之物有瑕疵,因此,依法得向乙、丙各請求二十五萬元之損害賠償。
