Title:	德國關於美容醫學醫療廣告之自律與法律規範

Abstract:	美容醫學（以下簡稱「美醫」）係對生命身體安全可能產生風險之醫療行為。實務上，民眾因美醫行為致生命身體健康受有損害之案例並不罕見。雖然，美容醫學廣告及行銷涉及醫療業者的言論自由與營業自由，但是在美醫屬於非必要性之醫療的情況下，業者進行商業化運作以吸引民眾的誘因及可能性更大，也有部分美醫業者的廣告及行銷內容可能欲使民眾忽略醫療風險，甚至刻意隱瞞風險。為了保護病人與社會大眾的健康與安全，在許多國家（包含我國），醫療廣告都是屬於法令上特別予以管制的一種廣告類型。由於德國無論在大陸法系的國家當中，或是在醫療技術與醫學實務的發展上，都屬於極為值得參考的重要國家，而且德國特別針對醫療廣告立有專法，故本文以德國關於美醫等醫療廣告之自律與法律規範，作為研究與分析對象，包括「德國境內執業醫師專業規範」（MBO-Ä）、「醫療廣告法」（HWG）以及「不正當競爭防制法」（UWG）的相關規定，並介紹討論若干德國法院的相關判決。最後並提出對於我國主管機關的建議。
