Title:	大陸首例「機票文字」糾紛案評述

Abstract:	"世界貿易組織(World Trade Organization, WTO)所表彰的貿易自由化(trade liberation),雖然可以為全體人類謀求物質與商業利益上之福祉;但商品之自由流通,仍可能因為公平或不公平之競爭關係,在市場機制或人為介入因素之影響下,使得某些位於相對競爭劣勢之產業遭到淘汰,並損及一國之經貿利益。對於公平競爭所致之淘汰結果,在大部分情況下為自由貿易所容許的1;然而,對於一國為保護自身產業之競爭利益而制定之不公平貿易措施,卻可能扭曲市場之競爭關係與公平性,而損及自由貿易之宗旨。故如何消弭不公平之貿易保護措施,以確保貿易活動之公平性與貨物之自由流通,向來為WTO與其前身關稅暨貿易總協定(General Agreement on Tariffs and Trade, GATT)所致力推動之目標。"
