Title:	動產善意取得問題

Abstract:	自羅馬法以來，「任何人不得以大於自己的權利讓與他人」一直是各國民法共識共守的大原則，主要的倒外便是動產交易的善意取得制度，使無權處分在一定條件下仍可生效。首先，立法者面臨的決定是；應該讓動產權利人保有其物權人的地位，還是使善意受讓人依其誤信及交易目的取得權利？因此涉及的似乎是所有人（或其他權利人）與善意受讓人之間的利益權衡問題。 "一、價值判斷與事實研究二、盜贓物、遺失物的善意取得三、質權的善意取得四、留置權的善意取得五、動產抵押權的善意取得六、附條件買賣中買受人期待權的善意取得七、無負擔所有權的善意取得八、優先次序擔保權的善意取得"
