    Title: 論大陸婚姻法關於夫妻財產制之修正

    Abstract: 大陸一九五年婚姻法關於夫妻財產制之規定,僅有一個條文,若再加上離婚時財產分割與債務之負擔等相關規定,亦不過三個條文(一九五年婚姻法十、二三、二四);三十年後,一九八年婚姻法關於夫妻財產制之規定略作修正,但條文數仍然不變(一九八年婚姻法十三、三一、三二)。如此簡單之規定,被學者批評為自其誕生之日起就存在某些先天不足,更因為自一九八年以來二十年間大陸社會發生重大變化,使得大陸婚姻法上之夫妻財產制之相關規定,又產生後天不適之結果。在先天不足方面,表現在立法技術方面之拙劣與內容之嚴重缺失。詳言之,在立法技術方面:一、在體例結構上,應將夫妻財產制之法律規範設於婚姻效力或夫妻關係之中,而原婚姻法卻將相關規定分散在夫妻關係與離婚二章中,顯然不妥;二、論理上既有夫妻共同財產之概念,就應有夫妻個人財產之概念與之相對應,惟原婚姻法並無規定個人財產或特有財產之制度,使得部分夫妻財產的歸屬在法律上不明確;三、在婚姻關係存續間亦可能發生夫妻財產分割之需要,而原離婚法僅規定離婚時財產之分割。
