Title:	德國的法定夫妻財產制

Abstract:	分別財產制與共同財產制為夫妻財產關係中之兩極，德國立法者以淨益共同制作為法定夫妻財產制，採取折衷的制度，乃有意規避兩極化帶來之弊病。這種制度旨在貫徹男女平權思想，以分別財產制為基礎，於婚姻關係存續中聽憑夫妻自由處分並管理各自響所有之財產。另方面為維護日後夫妻清算淨益財產之利益，卻又有限度限制夫妻處分財產之自由。淨益共同制，名實並不完全相符。所謂共同僅指計算淨益時的基礎或短暫現象而已。嚴格名之，實係分別財產制附加清算增值財產的並聯制度。 "壹、前言貳、淨益共同制之特點一、財產分離二、處分權之限制（一）處分全部財產之限制上 1.全部財產 2.他方配偶之同意（二）處分家用物品之限制 l.家用物品 2.他方配偶之同意三、淨益清算（一）配偶一方死亡時（二）其他情形 l.開始財產 2.終結財產 3.財產價值之計算 4.淨益清算債權 5.提前清算淨益參、結語"
