Title:	再論勞工保險申報制度 - 兼評臺北高等行政法院105年度訴字第554號判決

Abstract:	本文以臺北高等行政法院105年度訴字第554號判決為例，檢討勞工保險行政與審判實務所採行之所謂「申報制度」。實務上基於大量案件調查之困難，關於勞保法律關係之發生或停止，原則上以投保單位之申報為準，縱使受雇勞工未離職，而雇主申報其離職退保，勞保法律關係亦停止。本文認為，申報行為為事實行為，而非意思表示，勞保法律關係係公法上之法定債之關係，而非行政契約關係；勞保法律關係之發生或停止，固然原則上以申報為準，但雇主之申報（通知）內容如與事實不符，被保險人應得透過訴訟救濟予以推翻，至於救濟之訴訟類型，應為確認訴訟。
