Title:	國民年金保險遺屬年金請求權之財產權保障 - 兼評釋字第766號解釋

Abstract:	關於社會保險給付請求權是否受憲法財產權保障之問題，釋字第 766 號解釋正面回應此一問題，並指出社會保險給付請求權具有財產價值，受憲法上財產權保障。此一見解與德國聯邦憲法法院之見解不同，依其見解，公法上具財產價值法律地位須具備以下三要件，始受財產權保障：個人支配性、先前之自己給付以及作為維持生計之用。本文透過對於司法院相關解釋之觀察與分析，認為釋字第 766 號解釋並無意使所有公法上具財產價值之法律地位，無論其取得是否有所付出，均受財產權保障。以此為前提，本文就社會保險遺屬年金請求權，以及聚焦至國民年金保險遺屬年金請求權，檢討其是否受憲法上財產權所保障。
