Title:	表見要保人交付保險費之效力與不當得利

Abstract:	甲以自己為被保險人，向A保險公司投保人壽保險。保險期間內，甲之配偶乙冒用甲之名義，向A公司申請變更要保人為自己。A公司未發現冒名之情而同意其變更。嗣後乙再度向A公司申請變更要保人為乙之子丙，亦經A公司同意其變更，並繕發要保人為丙之新保險單。丙持續繳交保險費2年之後，甲才發現遭冒名變更要保人之事實，向A公司提出申訴。A公司知悉前述乙冒名變更之情後，便將該保險單之要保人更正為甲，同時向丙聲明其所簽發給丙之保險單作廢。丙認為自己既然不是要保人，便依不當得利之規定，請求A公司返還其2年間所支付之保險費共計8萬元，然遭A公司拒絕。A公司主張：一、丙本於要保人之地位繳交保險費，A公司並無不當得利；二、系爭契約二度變更要保人雖屬無效，然丙仍為保險契約之利害關係人，依法得代繳保險費，故A公司收取保險費並無不當得利；三、因丙代繳保險費而受利益者為甲，故應向丙負不當得利返還責任者為甲，而非A公司。請問：丙與A公司之主張，何者較有理由？
